The Lynch and Partners Family Law Team

John M. Lynch- Solicitor

John M. Lynch, managing partner at Lynch and Partners is an expert in Family Law and leads the family law team at the firm. He studied law in UCD and went on to qualify as a solicitor in 1981 and in 1983 he set up John M. Lynch and Co which expanded and changed its name to Lynch and Partners  in 2001.

As a country practitioner John is involved in all areas of law, with one of his current areas of expertise Family Law.  He has guided countless clients through various elements of the legal system governing family law. He has also experienced the process in a personal capacity. That personal experience combined with expert legal knowledge and over two decades of working with clients gives him a special ability to help find solutions during difficult and traumatic times.

John is both a trained collaborative lawyer and a Mediator.  In 2008 he was admitted as an Accredited Mediator by the Institute of Arbitrators following MATA training and has been involved in ADR (Alternative Dispute Resolution) since its introduction in Ireland. 

In furthering the concept of ADR John formed a group within the Bar Association for the promotion of ADR family law practice in the county (Tipperary) – this involved both collaborative practice and a new form of ADR - structured family law negotiations. In his practice he has initiated collaborative and structured negotiation practice in cases that he has been involved in with colleagues and he has  have been requested to act as mediator by colleagues on an ad hoc basis. To date he has been involved in numerous private client cases involving mediation, collaborative law and structured family law negotiations.

When it is not possible to resolve a case by ADR it is necessary to bring a case to hearing in Court.  John also has a special knowledge and training in advocacy which involves him in dealing with each case at hearing – he was on of the first solicitors to complete the NITA (National Institute for Trial Lawyers) Advanced Advocacy Certificates and has also tutoring on subsequent Certificate courses.  This enables the firm to have a consistent and client centre approached to each case – the client is involved in deciding how the case is to be handled and on the strategy to be adopted from the outset.

Gillian O`Mahony- Solicitor

Gillian O’Mahony graduated from the University of Limerick with an LLB degree in 2001. She commenced her apprenticeship with Lynch and Partners in 2002 and qualified as a solicitor in December 2005.   Gillian practices in the firm’s Family Law Department. She specializes in all areas of Family Law including Custody, Access and Guardianship, Domestic Violence applications, Maintenance for spouses and children, Judicial Separation, Separation Agreements, Divorce, Pensions, Recognition of Foreign Divorces and applications for annulment. Gillian’s experience includes the District Court, Circuit Court and High Court.  In addition, she has extensive experience in disputes between non-married couples in cases involving access, maintenance, paternity disputes and property/equity matters.

Gillian has also trained in Collaborative Law.  Collaborative law is an alternative dispute resolution method which aims at helping the separating couple reach solutions together in a non-confrontational way and without the threat of court proceedings. The couple, with the help of their solicitors, sit down face to face to work out their differences.

Gillian lectures regularly in Waterford Institute of Technology on Family Law matters and is a regular contributor to the local radio station in the area of Family Law. She has also recently obtained a Law Society Certificate in Advanced Advocacy for Solicitors and has completed the Law Society Family Law Diploma.

Mary Mullins- Legal Assistant

Mary is a valuable member of the family law team and has worked as legal support, dealing mainly with family law matters, for four years.  Since starting with Lynch and Partners, she has worked exclusively in the family law department and is familiar with all areas of family law to include District Court applications for maintenance, access & custody, domestic violence. Mary has experience in providing support to the Family law team on all Circuit Court and High Court applications ranging from Divorce applications to Judicial Separation and applications for annulment.

How We Work

The first consultation
The first consultation between one of our family law solicitors and a new client serves as a fact finding mission for both our client and our solicitor. Solicitors are obliged by law to discuss all options available to a person seeking a separation or divorce and this is a stage to which we devote great time and energy. We like all other family law solicitors are required to discuss the following options with our client:

  • the possibility of reconciliation with their partner and we provide the names and addresses of persons qualified to help effect a reconciliation.
  • the possibility of engaging in mediation to help effect a separation on an agreed basis (the spouses not being separated) or a divorce on a basis agreed between the spouses and we provide the names and addresses of persons and organisations qualified to provide a mediation service
  • the possibility of effecting a separation through a separation deed or written separation agreement with the other spouse.
  • making the client aware of the possibility of a judicial separation as an alternative to divorce, where no decree of judicial separation in relation to the spouses is in force

In addition to providing the above mandatory information we record all the relevant details of our client’s situation. We explain in detail what is involved in each of the courses of action available and give an indication of the likely timeframe involved in resolving the situation, depending on the course of action pursued and also the likely costs involved.

Top of our agenda with all clients who have children is discussing approaches to protecting children during what is a traumatic time for both the children and adults involved.

During all subsequent meetings our solicitors act as sympathetic listener and expert adviser, bringing to bear all their experience, understanding and expertise on each client’s individual situation.
